Terms and Conditions for EnglishWithRandy.com
1. Acceptance of Terms
By accessing and using the virtual English lesson services provided by EnglishWithRandy.com (the "Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you may not use the Service.
2. Service Description
EnglishWithRandy.com provides live, virtual, one-on-one, or group English language instruction ("Lessons") facilitated through an online platform. Lessons are sold in prepaid packages ("Lesson Tickets"). The purchase price is due in full at the time of purchase.
3. Payment and Lesson Tickets
3.1 Prepaid Basis: All Lessons must be prepaid before booking a class. Your Lesson Tickets will be credited to your account upon successful payment.
3.2 Non-Transferable: Lesson Tickets are non-transferable and may only be used by the registered student.
4. Cancellation and No-Show Policy
4.1 Required Notice: Students must provide a minimum of eight (8) hours notice to cancel a scheduled Lesson.
4.2 Loss of Lesson Ticket: If a student cancels a Lesson with less than eight (8) hours notice, or fails to attend a scheduled Lesson (a "No-Show"), the student will forfeit the Lesson Ticket for that session. The Lesson Ticket will not be refunded or rescheduled.
4.3 Instructor Cancellation: If an instructor needs to cancel a Lesson, the Lesson Ticket will be credited back to the student's account for immediate rebooking or use towards a refund calculation.
5. Refund Policy
All requests for a refund must be submitted in writing to EnglishWithRandy.com. Refunds are processed based on the remaining Lesson Tickets and the percentage of the package used, as follows:
5.1 Full Refund (Less than Half Used): If a student requests a refund and has used less than fifty percent (50%) of their purchased Lesson Tickets, a full refund will be issued for the original purchase price.
5.2 Pro-Rated Refund (More than Half Used): If a student requests a refund and has used fifty percent (50%) or more of their purchased Lesson Tickets, a pro-rated refund will be issued. The amount refunded will be the original purchase price minus the full value of the Lesson Tickets that have already been used.
5.3 Calculating Usage: For the purpose of this refund policy, a Lesson is considered "used" if the student attended the Lesson or if the student lost the Lesson Ticket due to a late cancellation or no-show (as per Section 4).
5.4 Refund Processing: Refunds will be processed within [Specify Number, e.g., 10-15] business days of approval.
6. Limitation of Liability
EnglishWithRandy.com and its instructors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your access to or use of, or inability to access or use, the Service.
7. Governing Law
These Terms shall be governed by and construed in accordance with the laws of [Insert Your Jurisdiction, e.g., the State of California], without regard to its conflict of law provisions.
8. Changes to Terms
EnglishWithRandy.com reserves the right to modify these Terms at any time. We will provide notice of any material changes by posting the new Terms on the website. Continued use of the Service after any such changes shall constitute your consent to such changes.
